Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Kapsule Inc. ("Kapsule", "we", "us"), including the website at kapsule.sh, the dashboard at app.kapsule.sh, and the Kapsule gateway (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Kapsule provides a managed gateway that sits in front of your APIs and applies security controls you configure — such as Cloudflare Turnstile bot protection, origin validation, and rate limiting — without requiring changes to your backend code.

Beta notice. The Service is currently offered as a public beta. Features may change, be interrupted, or be discontinued at any time, and service levels are not guaranteed during the beta period.

2. Your account

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@kapsule.sh if you suspect unauthorized use.

3. Your APIs and content

You retain all rights to your APIs, applications, and data. By routing traffic through the Service, you grant us the limited rights needed to operate it — receiving, inspecting for security purposes, and forwarding your traffic according to your capsule configuration. You represent that you own or have the necessary rights to the APIs you connect, and that your use of the Service complies with your own obligations to your users, including privacy laws.

4. Acceptable use

You agree not to use the Service to:

• Proxy, transmit, or distribute content that is illegal, infringing, or harmful.
• Circumvent, probe, or overload the security controls of Kapsule or any third party.
• Interfere with the integrity or performance of the Service or other customers' use of it.
• Resell or white-label the Service without our written permission.
• Use the Service to violate the rights or privacy of others.

We may suspend or terminate capsules or accounts that violate this section, with or without notice, to protect the Service and its users.

5. Fees

The Service is currently free during the public beta. We may introduce paid plans in the future; if we do, we will provide reasonable advance notice, and continued use of paid features after pricing takes effect will constitute acceptance.

6. Intellectual property

The Service, including its software, design, and branding, is owned by Kapsule and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or brand features. Feedback you provide about the Service may be used by us without obligation to you.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Kapsule adds meaningful security controls in front of your APIs, but no security product can guarantee protection against all threats, and we do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8. Limitation of liability

To the maximum extent permitted by law, Kapsule will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars (USD $100).

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, the rights granted to you under these Terms end, and sections that by their nature should survive (including Sections 6–8) will survive.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you through the Service or by email. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Kapsule Inc. is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless applicable law gives you the right to bring proceedings elsewhere.
